Court filing

Government asks court to deny universities' bid to pause SEVP's CPT broadcasts; hearing set for Nov. 6

On October 28, 2026, the U.S. Department of Justice filed its opposition in Association of American Universities v. DHS, asking a federal court in Boston to deny a preliminary injunction and stay of SEVP's August 2026 broadcasts on curricular practical training. The government argues the plaintiffs lack standing, that the broadcasts are guidance rather than final agency action, and that they restate the existing regulation, 8 CFR 214.2(f)(10)(i). On October 30 the court allowed the plaintiffs to file a reply brief; they had asked to file it by November 4. The broadcasts remain SEVP's stated position and no court has ruled. Judge Julia Kobick hears the motion on November 6 at 3:00 p.m.
