Judge sets October 26 deadline for summary-judgment motions in the duration-of-status case

A federal judge in Boston set the schedule for deciding the lawsuit over the duration-of-status rule on October 16. Judge F. Dennis Saylor IV ordered DHS to give the universities and unions that sued the administrative record, the agency's file behind the rule, and to file an index with the court by October 23. Motions asking the court to decide the case are due October 26, and replies November 2. The order does not lift the September 14 postponement, so the rule stays blocked and F-1 and J-1 students remain admitted for duration of status. DHS's appeal in the First Circuit is separate.
