Judge sets a November 6 hearing on the universities’ request to block SEVP’s CPT guidance
In the universities’ lawsuit over SEVP’s August broadcast messages on Curricular Practical Training, Judge Julia E. Kobick of the federal court in Boston has set an in-person hearing for November 6, 2026 at 3:00 p.m. on the plaintiffs’ motion for a preliminary injunction and a stay of the guidance. The notice, entered October 13, is the first scheduling step since the Association of American Universities, NAFSA, the Presidents’ Alliance and a Massachusetts college association filed the case on October 5. The government’s response to the motion is due October 19. Until the court rules, nothing changes: CPT is not suspended, the regulation is unchanged, and the broadcasts remain SEVP’s stated position, which many schools are applying to for-credit elective internships. The hearing date is the next one that matters for DSOs deciding CPT requests this fall.
