Final rule

DHS makes permanent the end of automatic extensions for expiring work permits

DHS published a final rule on October 14, 2026 that makes permanent the end of automatic extensions for expiring work permits (EADs) when a renewal is pending. Under the rule, which took effect the same day and adopts without change an interim rule from October 30, 2025, an EAD is no longer extended up to 540 days because a renewal was filed. The change applies to renewals filed on or after October 30, 2025. Anyone who needs an EAD renewal, such as an applicant with a pending green card application, loses work authorization on the EAD's end date if the new card has not arrived. The rule does not mention F-1 or J-1 students or OPT by name.
