When can I apply for STEM OPT?
Short answer: up to 90 days before your current post-completion OPT EAD expires — and not a day after it expires. The STEM OPT extension has a forgiving front edge and an unforgiving back edge, with a second deadline hiding in the middle that catches students every year.
The three dates that govern a STEM extension filing
- The 90-day front edge. USCIS may receive your Form I-765 for the 24-month STEM extension no earlier than 90 days before your current OPT employment authorization expires. 8 CFR 214.2(f)(11)(i)(C)
- The hard back edge. USCIS must receive the I-765 before your current OPT EAD expires. There is no filing from the grace period — once the EAD lapses, the extension is gone.
- The 60-day recommendation rule. Your DSO must recommend the STEM extension in SEVIS and issue you a new I-20; USCIS must receive your I-765 within 60 days of that recommendation. A recommendation that sits while you finish the I-983 can age out even though your EAD is still valid.
What your DSO actually provides — and needs from you
The DSO's piece is the SEVIS recommendation and the new I-20, and neither happens until the Form I-983 training plan is complete and signed by both you and your employer. The I-983 is where most delay lives: it needs a named supervisor, a real training plan tied to your STEM degree, and an employer who is enrolled in E-Verify. Your DSO cannot fix an employer who isn't in E-Verify and cannot backdate a recommendation.
If USCIS is still deciding when your EAD expires
Filed on time, you're protected: your OPT employment authorization automatically extends for up to 180 days while the STEM application is pending. Your employer's I-9 reverification uses the expired EAD plus the I-797 receipt notice. If the extension is approved, the new card runs 24 months from the day after your old OPT ended — you don't lose the pending time.
Eligibility, quickly
- Your degree must appear on the current STEM Designated Degree Program List (check the CIP code on your I-20, not the department's marketing name).
- Your employer must be enrolled in E-Verify and provide a bona fide employer-employee relationship — self-employment and most contractor arrangements don't survive this test.
- The work must be paid, at least 20 hours per week, and directly related to the qualifying STEM degree.

Can I apply for STEM OPT during my 60-day grace period?
No. USCIS must receive your STEM extension I-765 before your current post-completion OPT EAD expires. The grace period after OPT ends is for departure, transfer, or a change of level — not for filing a STEM extension.
Can I keep working while the STEM extension is pending?
Yes, if USCIS received the application before your OPT EAD expired: your employment authorization is automatically extended for up to 180 days while the extension is pending.
Can a previous degree qualify me for STEM OPT?
Sometimes. If your most recent degree is not on the STEM Designated Degree Program List, a prior qualifying STEM degree from an accredited, SEVP-certified U.S. school can be the basis for the extension, provided your current employment relates to that STEM degree.
